Japan Wi-Fi auto-connect Terms of Use

NTT Broadband Platform, Inc. (hereinafter referred to as "the Company") establishes these Terms of Use (hereinafter referred to as "these Terms") for the smartphone application Japan Wi-Fi auto-connect (hereinafter referred to as "this Application"), which is provided for the purpose of promoting the use of and improving the convenience of free Wi-Fi for inbound tourists and other users, and provides its services in accordance with these Terms.
When users use this Application, they shall be deemed to have agreed not only to these Terms but also to the other terms and conditions indicated below.

Article 1 (User eligibility)

The Company grants eligibility to use this Application to customers who have agreed to these Terms (hereinafter referred to as "Users").
Further, this Application shall be used by the individual who owns the device on which it has been installed.

Article 2 (Usage fees)

The fee for using this Application shall be free of charge.
However, the User shall bear the costs of equipment, such as communication devices, and communication expenses, such as for 4G/LTE, necessary for using this Application.

Article 3 (Features of this Application)

Users may use the following functions with this Application:

A function to search for Wi-Fi spots compatible with this Application.
A function to simplify the procedures for using the Public Wireless LAN Access Service via Wi-Fi connections compatible with this Application. (The provision of Wi-Fi and the Public Wireless LAN Access Service utilizing it are offered by companies, organizations, or similar entities collaborating with the Company (hereinafter referred to as "Area Owners"). To use the Public Wireless LAN Access Service, Users must fully agree to the Public Wireless LAN Access Service Terms of Use separately stipulated by the respective Area Owners or by Wi-Fi communication providers commissioned by the Area Owners.)
A function to support automatic connection to Wi-Fi networks compatible with this Application.
Provision of information regarding Wi-Fi services compatible with this Application.

The Company may add or change functions in this Application without prior notice.

Article 4 (Purpose of use and handling of information acquired from Users)

The Company shall handle information acquired from Users in connection with their use of this Application appropriately and in accordance with the Application Privacy Policy.

Article 5 (Copyrights, etc.)

Intellectual property rights related to this Application and various information, etc., displayed on this Application (including but not limited to copyrights, patent rights, utility model rights, design rights, trademark rights, and know-how) belong to the Company or to the respective holders of such rights.

Article 6 (Prohibited acts)

Users shall not engage in any of the acts listed below when using this Application:

Any act of reproducing, reprinting, redistributing, or otherwise using any or all images, data, information, etc., used in this Application, without prior written consent from the Company, regardless of whether such use is for payment or not, or its form.
Any act that infringes upon the copyrights, patent rights, utility model rights, design rights, trademark rights, know-how, or any other intellectual property rights of 1 the Company or any third party.
Any act that causes discomfort or offense to other Users.
Any act that damages the credit or reputation of others, or infringes upon the privacy rights, image rights, or any other rights of others.
Any inappropriate act performed for the purpose of obtaining benefits or rewards.
Any act that obstructs or hinders the provision of this Application or its use by other Users.
Any act that are in violation of laws or public morals.
Any other acts that the Company, based on reasonable grounds, deems inappropriate.

Article 7 (Disclaimers)

1. The Company makes no warranty whatsoever that this Application will be free from defects such as bugs, errors, or failures, nor that this Application or the computer systems related to this Application will operate without interruption.
Further, the Company makes no warranty whatsoever regarding fitness for a particular purpose, non-infringement of intellectual property rights or other rights, or similar matters.
The Company provides no guarantee and assumes no liability whatsoever for the quality or other aspects of Wi-Fi communication lines provided by Area Owners, which may be accessed via this Application.
The Company assumes no obligation to restore, correct, or otherwise rectify any defects in this Application, even if such defects exist.
The Company shall not be liable in any way, even if Users incur any loss, damages, or troubles arising from their use of, or inability to use, this Application.

The Company shall not be liable in any way, irrespective of the cause, for any loss, damages, or troubles (including but not limited to the loss or damage of User information) incurred by Users in the cases listed below, or in other similar situations:

Cases where this Application cannot be used due to the User's operating environment.
Cases where the Company modifies this Application or discontinues its use.
Cases where defects or malfunctions occur in the User's device, OS, browser, various software, or other peripheral equipment, or where the User's data is lost, damaged, etc., as a result of using this Application.
Cases where, in connection with this Application, there occur between Users, or between a User and a third party, any acts that violate laws or regulations or are contrary to public order and morals, or any instances of defamation, insult, invasion of privacy, threats, slander, harassment, or similar acts.

The Company makes no warranty whatsoever, whether express or implied, regarding the accuracy, completeness, timeliness, quality, or other aspects of information, etc., posted on this Application. Further, the Company shall not be liable in any way for any and all loss, damages, or troubles incurred by Users in connection with information, etc., displayed on this Application, or any changes, updates, or similar modifications thereto. The Company will not provide any answers to inquiries regarding the specifications of this Application. Furthermore, with some exceptions, Wi-Fi networks compatible with this Application do not have encryption implemented for the wireless segment. When engaging in communications that require security, please confirm that such communications are encrypted by SSL. Additionally, if needed, please use other Public Wireless LAN Access Services that support encryption, or services such as VPNs. Furthermore, with some Public Wireless LAN Access Services, access to sites or other content that Area Owners or communication providers deem unsuitable for use by minors may be restricted for the purpose of youth protection.

2. The Company does not guarantee the accuracy, truthfulness, or other aspects of the content of third-party websites linked from this Application (including advertisements and their linked websites, hereinafter referred to as "Linked Sites"), and further, the Company assumes no liability whatsoever for any damages (including, but not limited to, damage to software or hardware) incurred as a result of using such Linked Sites.

Article 8 (Discontinuation of this Application)

If the Company deems it necessary, the Company may suspend or terminate all or part of the functions of this Application without any prior notice. However, in the event of suspending or terminating this Application itself, the Company shall provide notice thereof at least one (1) month prior to such suspension or termination.
Furthermore, the Company assumes no liability whatsoever, even if Users incur damages as a result of such suspension or termination.
If a User violates any of the provisions of these Terms, the Company may suspend that User's use of this Application without any notice.

Article 9 (Changes to these Terms)

The Company may change the content of these Terms if it deems necessary, without obtaining the prior or subsequent consent of Users. If Users use this Application after such changes have been made, they shall be deemed to have consented to such changes.
When these Terms are changed, the Company will notify Users of, or publicly announce, such changes by a method it deems appropriate.

Article 10 (Damages)

If the Company incurs damages as a result of a User's violation of these Terms, the User shall be liable for such damages.

Article 11 (Compliance with laws and regulations, etc.)

In using this Application, Users shall comply with all relevant laws, cabinet orders, ministerial ordinances, local ordinances, rules, regulations, and orders, etc., in addition to these Terms.

Article 12 (Governing law and jurisdiction)

The governing law for these Terms shall be the laws of Japan. Further, if any dispute arises between the Company and a User in connection with these Terms and this Application, the Tokyo District Court shall be the exclusive agreed court of first instance.

Supplementary Provisions These Terms shall come into effect on June 25th, 2019.

Supplementary Provision 2 This document has been prepared in Japanese as the original text. Although it may be translated into other languages for convenience, in the event of any discrepancy between the Japanese original and a translated version, the Japanese original shall prevail.
